By accessing or using Clustea ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Use of the Service

Clustea provides AI-powered SEO content generation tools. You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all content generated through your account.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at contact@clustea.com if you suspect unauthorized access.

3. Subscriptions and Billing

Paid plans are billed monthly. You may cancel at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period — no partial refunds are issued. We reserve the right to modify pricing with 30 days' notice.

4. Free Plan

The Free plan includes 3 articles and 1 project. We reserve the right to modify or discontinue the Free plan at any time with reasonable notice.

5. Intellectual Property

You retain ownership of all content you generate using the Service. Clustea retains ownership of the platform, its code, and its AI models. You grant Clustea a non-exclusive license to process your inputs solely to provide the Service.

6. Prohibited Uses

You may not use the Service to:

• Generate spam, misinformation, or illegal content
• Reverse engineer or copy the Service
• Circumvent usage limits or access controls
• Resell access to the Service without written permission

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that AI-generated content will rank on search engines or achieve specific business results.

8. Limitation of Liability

To the maximum extent permitted by law, Clustea shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes by email.

11. Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.
