Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Clustea platform ("Service"), operated by Salhi Ahmed ("we", "us", or "our"), located at 73 rue Palestro, 26100 Romans-sur-Isère, France. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Clustea is an AI-powered SEO content platform that provides keyword gap analysis, content cluster generation, AI article writing, internal linking automation, and WordPress publishing. The Service is intended for professionals, entrepreneurs, and businesses seeking to improve their organic search visibility.

2. Eligibility and Account Registration

You must be at least 18 years old to use the Service. By creating an account, you represent that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@clustea.com if you suspect unauthorized access.

3. Subscriptions and Billing

Clustea offers the following plans:

• Free — 3 articles/month, 1 project, 1 competitor analysis, manual publishing only. No credit card required.
• Starter — $29/month — 15 articles/month, 3 projects, 3 competitor analyses, content clusters, internal linking, featured image generation, autopilot, Markdown + HTML export.
• Pro — $129/month — 50 articles/month, unlimited projects, unlimited competitor analyses, everything in Starter, priority support.

Paid plans are billed monthly on the anniversary of your subscription date. Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. We reserve the right to modify pricing with 30 days' prior written notice by email.

4. Refunds

We offer a full refund if you request it within 30 days of your first payment on any paid plan. After 30 days, cancellations take effect at the end of the current billing period and no partial refunds are issued for unused time. To request a refund, email contact@clustea.com with your account email and the reason for your request.

5. Free Plan

The Free plan is provided as-is. We reserve the right to modify, limit, or discontinue the Free plan at any time with reasonable notice. Free plan accounts that have been inactive for more than 12 months may be deleted.

6. Intellectual Property

You retain full ownership of all content you generate using the Service, including AI-generated articles, keywords, and clusters created through your account. Clustea retains exclusive ownership of the platform, its underlying code, algorithms, AI models, and all associated intellectual property. You grant Clustea a limited, non-exclusive, royalty-free license to process your inputs solely to provide the Service to you. We do not use your content to train AI models.

7. Prohibited Uses

You agree not to use the Service to:

• Generate spam, misinformation, defamatory content, or any content that violates applicable law
• Reverse engineer, decompile, or copy any part of the Service
• Circumvent usage limits, rate limits, or access controls
• Resell, sublicense, or redistribute access to the Service without prior written permission
• Conduct automated scraping or bulk data extraction beyond what the API explicitly permits
• Impersonate another person or entity

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that AI-generated content will achieve specific search engine rankings or business results. Rankings depend on factors outside our control, including search engine algorithms, competition, and your own website quality.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Clustea and its operator (Salhi Ahmed) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, loss of data, or business interruption. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid to us in the three (3) months immediately preceding the event giving rise to the claim.

10. Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that is harmful to other users, third parties, or the Service. Upon termination, your right to access the Service ceases immediately. You may delete your account at any time from your account settings; upon deletion, your personal data will be removed within 30 days as described in our Privacy Policy.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by French law, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romans-sur-Isère, France, unless mandatory consumer protection law in your country of residence requires otherwise.
